Well, we’re almost to 2012 and recently I posted my top 11 photos of ’11, so I thought I would dig around in my stats and share with you the items that a plurality of you decided to visit over the year. They’re ranked by number of views.

8: Crossroads. Help Me, Pathfinder! – A great post about my future education and where I want to go from here. I say it was a great post because it offered me some good conversations with people about the state of education, what I should focus on as I continue forward and helped me figure out where I truly am in my head.

7: Good Customer Service: America’s Tire – I’m thrilled that a “Good Customer Service” story made the list. The adage goes, a happy customer will tell no one, while an unhappy customer will tell everyone. That’s not true in my case, I try to give equal time to good and bad customer service.

6: O.H. in the E.R. – On of my funnier (and sad) posts about an ill-fated trip to the ER last August. My pain is your joy. The things you hear in an ER waiting room are rather funny. If you take the time to listen.

5: Following the Pack (or not) – A post from last February where I offer my commentary on a “gorilla marketing tactic” on Twitter that was horribly spammy. I found it interesting that my desire to speak up was met with extreme hostility and mob mentality, which border-lined on bullying. I still stand by my opinions and observations. Sometimes you have to go out on a limb. Be bold.

4: The Lone Zebra, an Educational Opportunity – Written regarding a kerfuffle in the Real Estate Community about copyright and trade dress infringement. This gave me an opportunity to put into real life practice some things I had been learning in my Business Law class. It was a great case study.

3: Guest Post: Judgment Between The Lines – I’m so thrilled you liked, or viewed, this post. It was an important post. A guest post by my close friend Sarah Salter, she writes about something I think we all struggle with: Judgement and its many forms. An extremely timely, timeless and poignant post, worthy of read, whether it’s your first time or tenth.

2: Missing The Mark: Sears – Christmas Customer Service – Wow. This post, written just six days ago, outlined some poor customer service I received from a National big box store. Outlining the systemic issues from corporate culture, to employee detachment (An employee adds his comments to the post) it has become one of my most popular Customer Service Commentary posts.

1: You’re Welcome?!? - A post from this summer, I volunteered at a women only half marathon this year, I was struck and moved that almost every single runner, no matter how fatigued or festive, took a moment to thank the volunteers, when all I really was doing was standing in the middle of the road. I’m very thankful and grateful that this is my number one viewed post. It makes me believe that you all enjoy a little bit of gratitude in our world and maybe we/I need to be sharing a little more of it.

I’m extremely proud of these posts and some of them I think are close to “my best.” I hope that this streak continues in 2012!

What My Blog Says About Me.

Lets be honest. I don’t put a whole lot of thought into my blog. I don’t have an editorial strategy of what I’m going to post. I do, however, put a lot of “me” into this space. The sub-theme, “Heaping Scoops Of My Brain,” isn’t just clever witticism, This space is really all about what I’m thinking at the moment.

I don’t have a tag cloud enabled on my blog for a reason. I don’t think it adds anything to your experience here. However, I was going through some of the features on the back-end of wp.com and I found it has a tag cloud of your commonly used tags and such. These are mine. As I approach the end of the year, and my 200th(!!) blog post, I was going to do some reflection to what I’ve learned in my time here. Prepare yourself. :)

I have never thought of myself as a motivator or as inspirational. I have always just thought myself as a storyteller, someone you can relate to and someone you’d like to call a friend.

Again, thanks for sticking around with me. I hope it gets better from here. (If you want to see the posts which are related to the above tags. Click on them, it should take you there.) Going through them, I learned a lot about my writing style and how it’s changed since I began this thing.

To Be (Re)Purposed To Death…

If you follow along, you’ll recall that I posted this: To Be Purposed To Death in which I describe my unhappiness at being affronted by all these networking events which turn into “cause”ups.

I took a great deal of flak from that. I was told: “It’s for a good cause, why don’t you just support it.” or “You could just not go.” And both of those are true, I could just stow it, or stay home, but I go for the networking, I’m an online fiend, but in my world, I’m always working to bring as much of that offline as possible… Why? Because I like people, I’m a social creature.

I was told, by the event organizer, that these speakers, at the regular events, would be charities, or causes, who could really use our help. I get that. I’ve been working with non-profits for the better part of 15 years, I started volunteering at a very young age, and I’ve been opinionated for longer than that, so I declare “SHENANIGANS.”

I’m miffed, why? Because this month’s speaker is from a Business Conference, not a Cause, not a charity, but a conference. What is the purpose of this conference?

“We’ll be talking about business models that work for profit AND for social good for 2 1/2 days at the Ambridge Event Center in Portland, Oregon”

A conference for business models… Not for Charitable causes… a conference which the asking price for this two-day event is…

I can only imagine how much good 700 bucks could do in a lot of small charities.

So I refer to my original argument, these aren’t being planned because they’re a good cause, these slots are being filled because the people know someone.

I guess that’s great enough to get ahead in the world, but call it what it is, “opportunistic,” and not what you want the world to think it is, “doing greater things…”

Let’s be honest. The only “good” you’ll be doing with this presentation is filling the conference organizer’s pockets.

First, I should apologize to you, my reader, as this could be a long post. Second, I am not an expert on anything I’m about to talk about, I’m approaching this as an outsider, from an educational perspective for a couple of reasons. I fully expect my opinions to be unpopular, but the subject is, I feel, well worth discussion. Please understand, I don’t have a dog in this hunt, I do not have a personal connection to any person involved in this complaint, but I do have an interest in the laws around this, and since I know many of my friends/readers come from industries which are constantly affected about the use of Intellectual Property I thought it would be prudent to contribute to the discussion.

Many of you, who know me through my use of social media,(Twitter, Facebook, Here on my blog) have heard me lament about my business law class. I’ve truly been having a rough time with it, mostly because the teacher is generally unreachable, so I’m having a go at it, alone. Now I don’t claim to be an expert but in my business law class, we had a lengthy discussion about the use of Intellectual Property (copyrights, patients, trademarks, trade dress, and service marks) by companies and individuals, which makes the following an interesting real life case study.

Recently a controversy has erupted over digital media. Since I work with real estate people and I happen to watch what goes on and what agents might have to deal with on a regular basis, so when I speak to agents, I’m coming from a place where I try to understand their business. I came across a news article by Real Estate Reporting company Inman News where a company from Washington State (The Lones Group) has filed a lawsuit against an individual (Daniel Rothamel, The Real Estate Zebra) and his company (Strong Team Realtors, inc) alleging  infringement over the use of the use of the imagery and word “Zebra.”

Now the complaint was filed in Federal Court as The Lones Group is a Washington State company and Rothamel/Strong Team are residents of Virginia. The court, will have to establish jurisdiction, this is significant, since it will be litigated, if it comes to that, in Seattle, Washington.

Now that we know the complaint and established jurisdiction, let’s define the case.  These are the items of redress the Plaintiff seeks to remedy.

  • Trademark Infringement: Infringement may occur when one party, the “infringer”, uses a trademark which is identical or confusingly similar to a trademark owned by another party,
  • Trade Dress: Trade dress is a legal term of art that generally refers to characteristics of the visual appearance of a product or its packaging (or even the design of a building) that signify the source of the product to consumers.

Also, you have to indicate the general public could be confused by the infringement. As best I can tell from reading the information is the following items make the two companies competitors. First: They both work in Real Estate (Location is regardless here, thanks to the wonderful world of the internet, anyone searching for Real Estate and in this case the term Zebra, could potentially bring the two of these results up at the same time. (Note: I attempted to qualify this, but the ensuing blog war has muddied the waters. When I searched “Real Estate” and “Zebra” the two of them come up within 10 results of each other.) Second: Each purports to be a Real Estate Speaker/Trainer on the subject of marketing; The Lones Group for profit (that’s the core of their business,) Daniel, I imagine, not for profit, speaks to real estate agents through his Blog (www.RealEstateZebra.com) and through the Inman News circuit events (www.agentreboot.com,) including Seattle March 11th. Daniel’s own website also claims to be “An Inspirational, Insightful and Motivational Source for REALTORS® and Real Estate Agents.”

Now, Since neither company has filed for copyright/trademark with the Federal Government (I searched for copyright here and for Trademark here) the court will look at the complaint from the perspective of “Doctrine of first use” which describes as plainly as it sounds, if you’re the first to use it in the arena, you get to claim it. Now this only lends to enforceability, had either one actually ran to the government and paid the fee, copyright trumps first use, every time. (I note, however, The Lones Group publishes with the following at the bottom of their webpage: “© 2007 The Lones Group Inc. ·-· 2200 Cornwall Avenue, Bellingham, WA 98225 ·-· (360) 527-8904″ and Daniel publishes his blog with the following statement at the bottom: “Copyright © 2009 The Real Estate Zebra. All rights reserved.”) It’s great to say that, but if you don’t have it, the courts aren’t going to take any of that into account. So now we have to establish first use! Now that we’ve established first use, we would have to argue the merits of the case and try to determine who has more  documentation, if the judge believes they are in fact competitors and if the Plaintiff has been Injured by the defendant’s actions. That I find interesting here is that the Plaintiff has registered a demand for jury trial, the more expensive of the two types of trials. This is surely calculated. I am not going to argue the merits of the case here, I’m just analyzing the standing to sue. Want to follow the case?

Here are some of my major take-a-ways from this who episode: First, You are you, and YOU ARE YOUR BRAND, you MUST protect it, file for the copyright or trademark, it’s a small, but necessary step, easy and it’s the only protection you have. Second, stand in the face of adversity, read any marketing tips out there: All press is good, even the bad stuff. Until now, ‘Nobody had heard of The Lones Group” now, everyone NATIONWIDE and beyond has heard of them, the people listed above has ensured they have a much larger footprint now. BP hasn’t gone out of business has it?

Finally, This, for me, has been a wonderful chance to exercise what I have learned in my business law class, that coupled with discussions with actual Intellectual Property attorneys has added to my understanding of the material. Who knows, I might actually pass this class yet.

The Bottom Line: You work hard to build your brand, business, image. You should endeavor to protect it. Trademark and Copyright registration is a small step to take to stay out of court, unless you’re on the good side.

I work in an industry where most people work on their own, yet inside a team, a group, or an office. The statement I never hear is “I don’t know.”

At least, I don’t hear it enough. As someone who teaches people how to utilize a system that will make their life easier and as someone who knows that education and learning is something you should never stop doing I often find myself wondering, why are people afraid to ask for help when they don’t know something?

We all do it. We all try to manage or find some way to cheat the system or cope in our own ways without asking those who have the knowledge or experience to assist us.

The people I see every day try to hone into an image, be it someone who is super technical, over personable or even just a hard-worker. I know these people are everything they claim to be, everything they want themselves to be and all it takes for them to be just a little bit better is to have the ability to ask for help, when you need help.

Do you ask for help? Do you recognize when you need assistance? Do you feel, should you need it, that you can reach out to those who can help?

Any of the above statements are hard to answer on your own. Only you can answer them.

There are many resources out there, locate them, and use them.

Commentary: Can you find me a house?

The views reflected here are my own and do not represent the organization I work for. That being said, this post is Real Estate related; therefore, if you don’t care about real estate, you can skip right by.

Recently there was a big Whoop-Ti-Do about a new blog that was being created. This blog is being written by some pretty great people in the Real Estate Industry, some heavy hitters. This blog will focus on agents who are Mac compatible.

What I find in the industry—and someone please correct me if I am wrong—is that as a consumer, I don’t care what kind of computer you’re using, I just care that you can find me a house. Your showing me a house on your iPhone/iPad is not going to make a greater difference to me than you emailing me a print out.

As a trainer in the industry, I find that a great deal of agents are still struggling to figure out email, yet there is a push in this industry to have the “Latest, Shiniest, Greatest” thing.  I guess if you’re an agent who has all that figured out, then great. This makes you a technology star in this industry. The question really boils down to: What are your clients looking for?

I’m a Gen-X’er who owns two computers (a desktop and a laptop), who teaches real estate technology and basic computer skills, who carries two separate phones, neither of which is an iPhone. Who thinks it would be great if people could use spell check.

As a consumer, what do I care what type of computer/technology you’re using? The real question is: Can you find me a house?

All the technology in the world isn’t going to make your consumers feel better. If it makes your life better, that’s great. I’m all for it. If it doesn’t help you understand inspections, contracts, or basic people skills, you’re going to sink in this industry and sink fast.

It seems to me, the only people who care about what type of technology an agent is using is the agent themselves. A cooperating agent doesn’t seem to care, a broker doesn’t seem to care and your clients probably don’t care. This all boils back down to the “Real Estate” image. Does driving that BMW make you seem more successful? Wearing that Armani Blazer? All the gold jewelery? Carrying the iPad. None of these things actually make you more successful, it’s hard work that makes you more successful.

Just my opinion.

Commentary: Stop Being Cool

This is my 100th post. It just seems fitting that I have another Soapbox Moment…

I was in a meeting this morning where I was suddenly overcome with a moment of rage. Everyone gathered ’round kept saying, “Wouldn’t it be cool if we did…., Wouldn’t it be awesome if we could make this happen?” I replied, finally.

“at what point do we stop being cool long enough for us to do what we’re good at?”

So I pose this to you, dear readers, because I see this every day, not only in my industry, but also in a lot of other industries:

Are you focused too much on being Innovative or Trendsetting that you’re losing site of what your core competency is? It’s never about how much you can accomplish in this life, it should always be about doing something well.

Dan Savage: You Do Not Speak For Me

A friend posted the following to his wall on Facebook as something he “Liked” as I continued to read, my blood started boiling, I started getting worked up and I was ready to spit fire, I’ve given myself a day to think about it. I’m still steamed.

The following is a letter from “LR” to Dan Savage after an interview regarding the “It Gets Better” campaign, of which I’ve even posted a message, you can read that message here. (You can see the back and forth between Dan Savage and the Letter Writer, here. Or below)

This letter and response is titled “Your Image”

I heard an interview with you about your It Gets Better campaign. I was saddened and frustrated with your comments regarding people of faith and their perpetuation of bullying. As someone who loves the Lord and does not support gay marriage, I can honestly say I was heartbroken to hear about the young man who took his own life.

If your message is that we should not judge people based on their sexual preference, how do you justify judging entire groups of people for any other reason (including their faith)? There is no part of me that took any pleasure in what happened to that young man.

To that end, to imply that I would somehow encourage my children to mock, hurt, or intimidate another person for any reason is completely unfounded and offensive. Being a follower of Christ is, above all things, a recognition that we are all imperfect, fallible, and in desperate need of a savior. We cannot believe that we are better or more worthy than other people.

Please consider your viewpoint, and please be more careful with your words in the future.

I’m sorry your feelings were hurt by my comments.

No, wait. I’m not. Gay kids are dying. So let’s try to keep things in perspective: Fuck your feelings.

A question: Do you “support” atheist marriage? Interfaith marriage? Divorce and remarriage? All are legal, all go against Christian and/or traditional ideas about marriage, and yet there’s no “Christian” movement to deny marriage rights to atheists or people marrying outside their respective faiths or people divorcing and remarrying. Why the hell not?

Sorry, L.R., but so long as you support the denial of marriage rights to same-sex couples, it’s clear that you do believe that some people—straight people—are “better or more worthy” than others.

And—sorry—but you are partly responsible for the bullying and physical violence being visited on vulnerable LGBT children. The kids of people who see gay people as sinful or damaged or disordered and unworthy of full civil equality—even if those people strive to express their bigotry in the politest possible way (at least when they happen to be addressing a gay person)—learn to see gay people as sinful, damaged, disordered, and unworthy. And while there may not be any gay adults or couples where you live, or at your church, or in your workplace, I promise you that there are gay and lesbian children in your schools. And while you can only attack gays and lesbians at the ballot box, nice and impersonally, your children have the option of attacking actual gays and lesbians, in person, in real time.

Real gay and lesbian children. Not political abstractions, not “sinners.” Gay and lesbian children.

Try to keep up: The dehumanizing bigotries that fall from the lips of “faithful Christians,” and the lies about us that vomit out from the pulpits of churches that “faithful Christians” drag their kids to on Sundays, give your children license to verbally abuse, humiliate, and condemn the gay children they encounter at school. And many of your children—having listened to Mom and Dad talk about how gay marriage is a threat to family and how gay sex makes their magic sky friend Jesus cry—feel justified in physically abusing the LGBT children they encounter in their schools. You don’t have to explicitly “encourage [your] children to mock, hurt, or intimidate” queer kids. Your encouragement—along with your hatred and fear—is implicit. It’s here, it’s clear, and we’re seeing the fruits of it: dead children.

Oh, and those same dehumanizing bigotries that fill your straight children with hate? They fill your gay children with suicidal despair. And you have the nerve to ask me to be more careful with my words?

Did that hurt to hear? Good. But it couldn’t have hurt nearly as much as what was said and done to Asher Brown and Justin Aaberg and Billy Lucas and Cody Barker and Seth Walsh—day in, day out for years—at schools filled with bigoted little monsters created not in the image of a loving God, but in the image of the hateful and false “followers of Christ” they call Mom and Dad.

 

I know that’s a lot to read and If your face is a little red with anger, I’m sorry. I apologize for this crackpot’s words.

First of all. CHILDREN ARE DYING. Gay, Straight, Black, White, Christian, Atheist. Children ARE dying.

While I agree the It Get’s Better Campaign is one of the best things to come out in a long time. I disagree there is any comparison to a person’s faith (or lack thereof) when it comes to bullying. From my experience, it’s not the followers who have given me the most grief in my life, it’s those who have hate in their heart.

I understand people who have issues with religion, and those who are followers. I myself struggle with religion and faith. I wouldn’t say I’m lost. I just don’t know what I’m looking for. What I do know, is regardless of my beliefs and regardless of my friend’s beliefs, they believe in me, and I likewise believe in them.

Mr. Savage, you’ve taken this discussion to a whole separate level. Gay Marriage has nothing to do with children dying. Chew on this for a moment, according to the National Institute of Mental Health, in 2007…

In 2007, suicide was the third leading cause of death for young people ages 15 to 24. Of every 100,000 young people in each age group, the following number died by suicide:

  • Children ages 10 to 14 — 0.9 per 100,000
  • Adolescents ages 15 to 19 — 6.9 per 100,000
  • Young adults ages 20 to 24 — 12.7 per 100,00

I REPEAT: Children are dying

Mr. Savage, you include in your response the phrase, “Fuck your feelings”. This leads me to believe, you weren’t hoping to make things better for everyone, you didn’t learn anything from your “It Gets Better” program, you used it for it’s instant popularity. I believe many kids and adults are getting stronger because of it, but you chose to erase all your good will for ANOTHER single moment of stupidity. It pains me to think you have any credibility as a speaker for the Gay Community.

To the people of faith out there, I still consider you my allies. It’s fairly certain you and I will not agree on all things, however, I believe the greater cause here will encourage all of us to think about our words, what we teach each other, what we will allow our friends to get away with and will also cause us to examine what we teach our children.

While I know there is a deep fissure between “organized religion” and the “gay community” there are strong people on both sides working towards the middle, extending hands to shake and closing that gap. Lets keep that in mind when we speak or when we generalize.

I’m sorry for the super long blog post, but I have always thought, when you see something, say something. I’m putting away the soapbox. Thanks for listening.

A side note to “LR”: I care about your feelings. I know from reading your letter you were deeply affected by the suicides of these children, as we all are. I hope we can move past the hateful message of Mr. Savage and I hope we can continue to work together towards the goal of better lives for all people and someday we’ll all move past the hurt feelings of the past and save some lives.

Commentary: “Burn the Koran Day” – WTF?

Normally I go out of my way to stay away from Political or otherwise incendiary commentary on my blog. Mostly because I know there are people who do it for a living and I also know there are people who don’t want to read about it. This time, I just can’t be silent about it. I can’t let this pass by without at least a small rant, so please bear with me. If this doesn’t interest you, I understand. But I couldn’t not comment on it.

In protest of what it calls a religion “of the devil,” a nondenominational church in Gainesville, Florida, plans to host an “International Burn a Quran Day” on the ninth anniversary of the September 11, 2001, attacks.

The Dove World Outreach Center says it is hosting the event to remember 9/11 victims and take a stand against Islam. With promotions on its website and Facebook page, it invites Christians to burn the Muslim holy book at the church from 6 p.m. to 9 p.m.

As a friend of mine says: “That just sets my blood to boilin!” In this day and age, how can someone think that it would be a good idea to burn another religion’s holy book? Let alone, how could a Christian Church think this was a good idea? How could anyone, who follows the teachings of any Church think this was a Kind, Just or smart thing to do?

I’m not a particularly religious person to begin with. That being said, There is no reason that we should stand idly by and not lift our voices in outrage. I can’t imagine that this church would think it was a good idea to take on the est. 1.5 BILLION followers of Islam. The last time I checked, the Church preaches tolerance. This is anything but.

Seriously.

Also Interesting. I’ve been reading that the Allied Commander of the Troops in Afghanistan, David Petraeus says that this Church’s actions will threaten the Military; Yet, the Church is going to go forward. This is ridiculous.
